Rescission of Executive Order 11246 Implementing Regulations
What happened
On January 21, 2025, President Trump issued Executive Order 14173, "Ending Illegal Discrimination and Restoring Merit-Based Opportunity," which revoked Executive Order 11246. Accordingly, the U.S. Department of Labor published this final rule, effective October 26, 2026, to rescind the implementing regulations for Executive Order 11246. This also modifies administrative enforcement proceeding procedures at 41 CFR part 60-30 to remove E.O. 11246 components.
Why it matters
Federal contractors and subcontractors are no longer subject to the affirmative action requirements and nondiscrimination obligations previously enforced under Executive Order 11246. This means that contractors with 50 or more employees and a contract of at least $50,000 are no longer required to develop and maintain written affirmative action programs.
