General Services Administration Property Management Regulation (GSPMR): Nondiscrimination in Programs Receiving Federal Financial Assistance
What happened
Donald Trump signed a final rule from the General Services Administration (GSA) that updates its regulations for implementing Title VI of the Civil Rights Act of 1964. Effective September 14, 2026, these revised GSA regulations, moved to the GSPMR, now prohibit only intentional discrimination based on race, color, or national origin in programs receiving Federal financial assistance. The GSA will no longer pursue claims based on "disparate impact" (unintentional discrimination) against its funding recipients, aligning with changes made by the U.S. Department of Justice (DOJ) and Executive Order 14281.
Why it matters
This change means GSA will only intervene in cases where discrimination based on race, color, or national origin is proven to be intentional. Programs receiving federal financial assistance from GSA will not face action for policies that unintentionally have a disproportionate impact on certain groups. It clarifies the legal standard for nondiscrimination enforcement by the GSA.
